What choices do you have to make as a confidential service?
The eIDAS regulation continues to develop. For example, eIDAS 2.0 recently emerged, introducing new electronic trust services and a European Identity Wallet for citizens and companies. Under eIDAS 2.0, the requirements for Trust Service Providers have also become stricter to guarantee higher security and reliability standards. We also expect many developments and updates in the future.

As a trust service provider, you must closely monitor these developments to make the right choices. Critical strategic decisions include:

  • Will I become a Qualified Trust Services Provider (QTSP)? Or is a TSP sufficient?

  • Which trust service(s) will I set up and provide?

  • Which partnerships do I enter into with suppliers and other parties?

  • Do I purchase "white-label" trust services (or parts thereof)? Or do I build everything myself?

  • Will I perform trust services 'remotely' or through another means?

  • On which infrastructure will I run my trust service(s)?

  • To which customers will I provide my trust service(s)? And do I only do this nationally or in other European countries?

  • What will be my approach, and what is my roadmap?

  • How do I ensure that the business case meets the set expectations?

In fact, every trust service provider must have a good business plan, including a roadmap and approved business case, which is reviewed every year.

​Legal framework
As a trust service provider, you must deal with strategic choices and business matters as well as the legal framework. The eIDAS regulation is, of course, a very important one, but you must also take into account AVG (GDPR), NIS2, the Telecommunications Act, and other national legislation, such as some provisions from the Civil Code.

Therefore, it is good to draw up a clear legal framework in advance that you must comply with and ensure that you demonstrably comply with it.
